National Conciliation and Mediation Board
Regional Branch No.5
31 July 2018
Legazpi City – An Account Executive from a popular wholesaler of mobile smart phones sought the intervention of the Branch through the Single-Entry Approach (SEnA) program for alleged illegal dismissal. He came to the Branch requesting for assistance in getting back his money claims representing unpaid salaries, incentive pay, 13th month pay, tax refund, reimbursement of expenses covering the period of two months and other incentives he believes accrue to him, among others.
Single-Entry Assistance Desk Officer (SEADO) Josephine Amaranto handled the request. After a thorough interview to verify the truth of the allegation, Amaranto found out that the complainant already filed his resignation prior to his dismissal.
On the initial conference, the management representative insisted that the requesting party was not terminated. In fact, he was even asked why he did not report for work. He replied that he did not report for work because the Regional Manager texted him not to report after he extended his leave without prior authorization.
After some clarifications and discussions, the parties agreed to meet again for the payment of benefits.
On the next conference, the responding party paid the money claims of the complainant amounting to P26,480.35. The Certificate of Employment and Clearance was issued to the requesting party. The case is now considered settled and dropped from the case calendar of the Branch.
